Re: kite insurance

. Below find excerpts from my recent series of emails to and from Richard Gowers of the British Kitesports Association BKSA regarding my 100% UNSUCCESSFUL ATTEMPT to examine their SUPPOSED “insurance” “policy document” . Importantly, he REPEATEDLY IGNORED my request to provide the CORRECT location o...

Re: Florida to Regulate Parasailing & Kitesurfing

The one that Sachs originally wrote was passed earlier this month, this looks like the newest bill and includes wording on kiteboarding http://www.flsenate.gov/Session/Bill/20 ... ext/c1/PDF it looks like the only thing relevant for kiting is that you can no longer kite within a 1 mile radius of an...

[quote="RichardM" For those of us who tend to get a little peeved at having OTHER people tell us what we " SHOULD be able to live with ", INCLUDING such things as legislation which may set a precedent for OTHER areas, please let me know WHERE I can find the current bill wording . Re: Florida to Regulate Parasailing & Kitesurfing

There are lots of old laws on the books that are archaic and unenforced, for good reason. Where kiting is concerned, I would work to avoid complaints and old laws being dredged up and used against our access and sport. Talking about them isn't a great idea in short. In Florida, I am aware of very f...

Re: kite insurance

Re:contra preferentum - this tends to be taken more seriously/is enforced in the UK ! The area above the high water mark belongs to whoever owns the adjacent land. Some of it is privately owned, but most belongs to local authorities. The area between the high water mark and the low water mark belon...

Re: kite insurance

It is my understanding that many beaches in the UK are PRIVATELY owned. I'd be interested to know if there is any clause in the policy which RELEASES anyone such as landowners from liability for injuries suffered by the policy holder (kiter) and if so, what the EXACT wording is. Re:contra preferent...

Re: kite insurance

Under UK law, insurance policies are subject to contra preferentem, whereby in the event of any doubt, any favour will inure to the Insured (not the Insurer) - basically if the policy of insurance is unclear/reads like bollox, the claimant gets the benefit of the doubt. In t he UK we have BKSA insu...

Re: kite insurance

. Personally, I have little faith in stories alleging that some "insurance" paid a "minor" claim - I consider anything under $10,000 a "minor" claim since it is unlikely that anyone in the US would sue for such a claim. That being the case, the fact that someone alleges that some "insurance" company...
