Rule #5 is worded improperly. An overtaking rider does not have "priority" in any other wind driven water sport.
The overtaking rider has "responsibility" to avoid the rider being overtaken. This means if you are overtaking, you must give the overtaken rider room to manuver since he can not see you as easily as you can see him, and the more manuverable craft almost always must yield to the less manuverable craft.[/u]

I think you read it wrong - It say the overtaken rider has priority

#4 should say: "When crossing, both riders should turn to avoid a collision."
And #3 should say: "When crossing or overtaking, the downwind rider should lower his/her kite, and the upwind rider should raise his/hers."

Which way should we turn? I've read about 20 threads to do with right of way and everybody seems to think that there own personal right of way rules are better than any published rules. This is a pretty clear and works. Go with it!

Agreed.... just randomly deciding to avoid each other might not always work, and on the water communication can be misread and might result in a collision.....
All conditions being equal, someone has to have rights... it's just easier and safer that way.

Good catch stiffingandshifting. You're right, I did read it wrong.
In the translation the wording became less clear than just saying the the overtaken rider has right of way. I suppose right of way could translate to higher priority.

Something to note about all the legal shit: if you have the opportunity to avoid a collision, then even if you have the right-of-way, you are legally required to try to avoid the collision. If you see someone running a red light and you jump out in front of them as soon as your light turns green, YOU are the one at fault.
If one person assumes they have right-of-way because the law says so, you're already half-way to a collision - DRIVE DEFENSIVELY!!! I suppose it's comforting to know that the family of the deceased would probably win the lawsuit, but I'd rather get a few more sessions before I check out...
