I wouldn't know how it works of course legally where he is kiting, but at least he seems to have an agreement with the "locals" (taking his word for it). So if the "locals" "own" the beach ("access point") then wouldn't you say he does?

There technically is a local ordinance banning kiting in this area
If you know the locals, get them to rid you of the ordinance.
And put up with visiting kiters.
Or be an ass by kiting in spite of it, while keeping others out.
You risk that others will learn that the locals and their government are corrupt.
Then they will likely ignore the ordinance, and may ignore other laws in your community, to the point where problems occur.
And how welcome will you be at other spots if you try to enforce localism at yours?
It would be interesting to know why there was such an ordinance in the first place, and other details, but the fact that you aren't comfortable about the situation indicates you may not have as much clout locally as you might like, so be careful, whatever you do.
Remember, it can always get worse!

Conversation is the only way to go.
Sure conversation might not prevail; the spot might be blocked off and you have to find a new spot to get your kiting kicks. And from what you are describing it sounds like that is a real possibility after years of 'getting away with it because you are a good guy'.

Unfortunately not everyone is and that might lead to closure. But maybe we are all just misunderstood (that's what I grasp onto anyway) and you can all hug it out in the end....seems to me the only way to get there is thru conversation.

Hope you can keep riding, doing what you love doing.

In the south of France and Spain it's the police that come and wait for you to get out of the water then give you fines. You don't want things to become like this, a few incidents and before you know it the local councils make enforceable rules with associated fines and no one can kite anymore. Going the club way is one way to do it but enforcement is left to the members and that's almost impossible to stop anyone coming over. Councils are risk adverse and will do their best to stop everyone enjoying life.
