Not if you win.
The looser pays.
And this is a clear case
Assuming the counter party has the money to pay.

Legal counsel would advise you to not publicly comment on your case. Getting the FBI involved for such a petty act will be a challenge, you’ll have to be able to not only prove real damage but also that the person you believe is behind this has actually done something. Remember the hacking of Podesta’s email? Good luck!

Some people thrive on attention, looks like this is the case here too. Lawyers only do the bare minimum unless they make money (damages 12.5k+ in germany), judges often don't know what is what or try to get you to settle or decide something stupid and you have to take it further. You can never say a case is clear when in front of a judge, can go either way no matter what. I learned that the hard way. What is your plan for the next troll? You can't sue them all withtout losing your insurance/funds to fight with all of them.

The forum is Toby’s baby and it’s for all to contribute and benefit from. It’s not a fighting/pissing/trolling match plaza. Somebody talk to the guy in person maybe. Make peace. Cheaper option.
Also when one’s physical location is known people tend to become a bit more practical face to face.

Why has foilholio got an issue with kiteforum? What's his motivation for causing all these issues? Is it that he's got something specifically against Toby/kiteforum, or is it simply that he enjoys causing trouble?

Maybe Pansh pays him or gives him an extra deal...for spamming forums.
His mission is also to fight big brands...he rather has several smaller brands.
Definitely a guy with mental issues, which shows all he does...

Here's my 5 cents.
Trolls love to watch the world burn and they love the fight and attention. It is a game to them. The more fight the more attention the better, He will be fueled by this thread for example. He will absolutely be loving that there is another 5 pages dedicated to him,
Just silently delete his accounts and posts as they pop up. Do not make anymore fan fare about foilholio. Delete any and every post he has ever had on Kiteforum. Once you have received info you need on this thread delete it. Just keep removing data without online comment. Don't ever mention his name again. Just delete as required.
If you remove the attention and fight from the scenario then he will fade away in time. What is the point of attack if he is receiving no gratification?
In the back ground go about finding who he is and contact details. Then contact him and ask him to desist. Once you know who he is and confront him he will probably stop immediately.
I agree with others. Litigation should be the absolute last resort. The likely hood that you come out cash positive is pretty much zero and the opportunity cost to you will be huge. The legal battle will consume your time and money literally for years. That is time and money you can use to promote/improve your business.
Right now you need to concentrate on stay in business activities. Just silently delete, delete, delete and try to give him as little thought as you can. The more he consumes your time the more he wins.
The biggest help we as forum members can do is inform you via pm if we see his activity and not interact with that activity should it occur. It takes 2 to have an argument.

This.^
Just destroy his existence, it will hurt more than any litigation, you could also write a little 'Without prejudice' missive to Pansch (whoever they are, I've never heard of them)but threaten them on the assumption he's an employee and they'll probably react favorably as well.

But if he simply does not pay, then what?
You have to make a business decision.
As plummet says above "the more he consumes your time the more he wins".

Pansh barely reacts to customers. I think it's a single person making kites in China. Maybe they are working for the CCP to make kiteboarding lame and demoralize people in the rest of the world? I doubt they would respond to any stimulus other than an order for a kite on the website. Why waste any time with them?

This is the best advise.
